Terms and conditions

This English version is a translation provided for convenience. In case of any discrepancy, the Romanian version prevails.

1. Who we are

The online store mitzapet.ro ("Mitza", "we") is operated by Dumlu Emre Persoană Fizică Autorizată (authorised sole trader), registered office at Str. Ion Ghica nr. 240A, Corp C3, Camera 1, loc. Ghergani, oraș Răcari, jud. Dâmbovița, Romania, Tax ID (CUI) 50650492, Trade Register No. F2024010843004, EUID ROONRC.F2024010843004.

2. About these terms

These terms apply to all orders placed on mitzapet.ro by consumers, meaning individuals buying for personal purposes. By placing an order you confirm that you have read and accept these terms, together with the Privacy policy, the Delivery page and the Returns page. You must be at least 18 years old to order.

3. Products and prices

• We describe our products as accurately as possible, with dimensions, materials, instructions and warnings. Colours may look slightly different depending on your screen. Some presentation images are created or edited digitally and are for illustration purposes; the shape, dimensions and functions of the product are those in the description.
• Prices are shown in lei (RON) and are final prices, with all taxes included. The delivery cost is shown separately, before you place the order.
• Bundle discounts (for example, 2 units) are applied automatically in the cart, under the conditions shown on the product page.
• If a price is displayed incorrectly because of an obvious error, we'll let you know before shipping and you can choose to confirm the order at the correct price or cancel it, with a full refund of the amount paid.

4. The order and the contract

After you place your order, you receive an automatic confirmation of receipt by email. The contract is concluded when we send you confirmation that we have accepted the order, or when the product is shipped, whichever comes first. We may refuse or cancel an order only for objective reasons (for example, the product is unavailable, the delivery details are incomplete, or fraud is suspected); in that case we'll let you know and refund any amount paid in full.

5. Payment

• Online, by card or through the digital wallets shown at checkout (for example, Apple Pay or Google Pay). Payments are processed by Shopify and its payment partners; we don't see or store your card details.
• Cash on delivery, to the courier, when you receive the parcel.

The invoice is issued in the name and address in the order and is sent by email.

6. Delivery

We deliver in Romania, by courier. Delivery times, costs and steps are described on the Delivery page. If we can't deliver within 30 days at most from the conclusion of the contract, we'll let you know and you can cancel the order with a full refund of the amount paid. The risk of loss or damage to the product passes to you when you, or a person designated by you (other than the courier), take possession of the product.

7. Right of withdrawal

Under Government Emergency Ordinance (OUG) no. 34/2014, you have the right to withdraw from the contract within 14 days of receiving the product, without giving any reason. For Mitza products we voluntarily extend this period to 30 days, under the conditions described on the Returns page, where you'll also find the withdrawal form and how returns and refunds work. The direct cost of returning the product is paid by you, except for non-conforming products.

You are only liable for any reduction in the value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.

8. Legal guarantee of conformity

All products benefit from the 2-year legal guarantee of conformity from delivery, under OUG no. 140/2021. If the product is not in conformity (it has a defect or doesn't match the description), you have the right to ask for it to be repaired or replaced, and if this isn't possible or isn't done within a reasonable time, a price reduction or termination of the contract. Write to us at mitzasupport@gmail.com with a description and a few photos. Shipping costs for non-conforming products are paid by us.

Damage caused by use contrary to the instructions (for example, mounting on glass or on a desk top thicker than indicated, exceeding the maximum weight) or normal wear and tear is not a lack of conformity.

9. Safe use

Please read the instructions and warnings on the product page and in the parcel before use, check the tightness of the clamp regularly and don't exceed the maximum weight indicated. We are not liable for damage caused by using the product contrary to the instructions. Nothing in these terms limits our liability where the law does not allow it.

10. Reviews

We publish the reviews we receive, positive or negative, without changing their content. Reviews marked "verified buyer" come from orders placed on mitzapet.ro. We may refuse reviews that contain offensive language, other people's personal data, or that are not related to the product.

11. Intellectual property

The Mitza name and logo, the texts, images, videos and design of the website belong to us or are used with the right to do so. They may not be copied or used for commercial purposes without our written consent.

12. Personal data

We process your personal data in accordance with our Privacy policy.

13. Complaints and dispute resolution

If something isn't right, please write to us first at mitzasupport@gmail.com; we try to solve any problem amicably, as quickly as possible. You also have the right to contact the National Authority for Consumer Protection (anpc.ro) or an alternative dispute resolution entity (SAL).

These terms are governed by Romanian law. Any disputes are settled by the competent courts in Romania, without limiting the rights you have as a consumer.

14. Changes

We may update these terms. Each order is governed by the version in force on the date it was placed.
